Terms of Service

These terms govern your use of the PowerBand website at powerband.fit, the PowerBand iPhone app, the PowerBand sensor and bands, and any pre-order you place ("the Service"). By using the Service or placing an order you agree to these terms. If you do not agree, please do not use the Service.

1. Pre-orders and purchases

• Pre-orders. PowerBand is in development. Items you pre-order have not shipped yet. Ship dates, prices, specifications and product designs shown on the website are estimates and may change before release.
• Payment. Payments are processed by Stripe. By ordering you confirm you are authorised to use the payment method. Prices are shown in US dollars. Taxes and shipping, where they apply, are shown on the payment page before you pay.
• Order acceptance. An order is not final until we confirm it. We may cancel an order, with a full refund, if an item is unavailable or we suspect fraud or a pricing error.
• Returns. We offer a 30-day money-back return on purchases, as shown on the website. To start a return, contact us at the address below, and return the products in reasonable condition.
• Delays. If shipping is delayed we will tell you. If we cannot deliver your pre-order, you may cancel for a full refund.

2. Using the app and sensor

• You may use the app and sensor for your own personal, non-commercial use.
• You may not copy, reverse engineer, resell, or interfere with the app, the sensor firmware or the website, except where the law allows it.
• You are responsible for keeping your phone and sensor secure, and for the data you export from the app.

3. Safety and health

• Not coaching or medical advice. Metrics, scores and trends are for general information and fun. They are estimates and may be inaccurate. They are not medical, coaching or injury-prevention advice. Talk to a qualified professional before starting or changing a training program.
• Physical activity has risk. Tennis, pickleball, padel, golf, boxing and similar sports can cause injury. You take part at your own risk.
• Mounting the sensor. Attach the sensor only as shown in the instructions. Check that the sensor, bands and strings are secure before play, and stop using any part that is damaged. Keep the sensor, charging puck and small parts away from young children. Do not use it in a way that interferes with the rules of your sport, competition or venue.

4. Your content and data

Your sessions and exports belong to you. We do not claim ownership of them. Because they stay on your device, we do not have a copy to give back, so please export anything you want to keep. Our privacy policy explains how information is handled.

5. Our rights

The PowerBand name, logo, app, website, designs and software are owned by us or our licensors and are protected by law. We grant you a limited, revocable, non-transferable licence to use the app and website for their intended purpose. We may update, change or discontinue features at any time.

6. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent the law allows, we make no promises that it will be uninterrupted or error free, or that measurements will be accurate. Nothing in these terms limits any rights you have under consumer law that cannot be waived.

7. Limit of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential damages, loss of data or profits, or damage to equipment, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us for the product that gave rise to the claim. Nothing in these terms excludes liability that cannot be excluded by law.

8. Ending use

You may stop using the Service at any time. We may suspend or end your access if you break these terms or misuse the Service.

9. Changes to these terms

We may update these terms. The date at the top shows when they were last revised. If you keep using the Service after a change, you accept the updated terms. We will not change the terms of an order you have already placed in a way that makes it worse for you.

10. Governing law

These terms are governed by the laws of [state or country, to be confirmed], without regard to conflict-of-law rules. Disputes will be handled in the courts there, unless your local consumer law gives you the right to use your local courts.
